TERMS AND CONDITIONS OF UNIQUE COMPORTA

1. GENERAL ASPECTS

The stated terms and conditions apply to the services provided by UNIQUE COMPORTA.

The use of the site automatically attributes the condition of the User and implies the acceptance, fully and without reservation, of all the provisions included in the Terms and Conditions, in the version in force at each time when accessing the site. If you do not fully accept any of the conditions established, you should not access/use our website. By consulting, using, or downloading the content of the website, you are committing to respect the conditions set out in this document.

The User will be able to use the site, without the need for any registration. However, some of the site’s features may be registration-dependent.

3. CHECK-IN

The check-in will be done preferably 15 to 30 minutes in the period before the departure of the vessel.

4. RESERVATION POLICY

Reservations must be made through the website https://uniquecomporta.com, by email at info@uniquecomporta.com, or by phone at +351 964 643 609.

Payments can be made by Bank Transfer, Credit, or Debit Card. If the reservation is made 48 hours before the departure of the vessel, payment must be made at the place of departure with a Credit Card.

6. CANCELLATION POLICY

UNIQUE COMPORTA reserves the right to cancel any departure whenever:

a) The weather conditions are inappropriate and adverse when leaving the vessel, putting passengers and crew and the vessel itself at risk.

In view of these situations, a new schedule will be suggested by UNIQUE COMPORTA. If it is not possible to make a new appointment, the refund to the customer will be made in full.

b) The maritime and land authorities prohibit navigation for any reason.

In view of these situations, a new schedule will be suggested by UNIQUE COMPORTA. If it is not possible to make a new appointment, the refund to the customer will be made in full.

c) The behavior on board by passengers is not in line with good navigation practices, which means: throwing objects into the water or towards other vessels, physical, psychological, or verbal violence between passengers or with the crew. In view of these situations, UNIQUE COMPORTA cancels the return trip to the Troia Marina without any refund.

Customers may reserve the right to cancel the reservation whenever:

a) The health problem is proven and documented and has not been previously known to you. In view of these situations, a new schedule will be suggested by UNIQUE COMPORTA. If it is not possible to make a new appointment, the refund to the customer will be made in full.

b) The impossibility of carrying out the tour due to the death or illness of a family member is proven and documented. In view of these situations, a new schedule will be suggested by UNIQUE COMPORTA. If it is not possible to make a new appointment, 50% will be refunded to the customer.

c) It is proven and documented that, for professional reasons, the tour cannot take place. In view of this situation, a new schedule will be suggested by UNIQUE COMPORTA. If it is not possible to make a new appointment and provided that the client has communicated to UNIQUE COMPORTA with a month or more in advance the refund will be made in full. If the communication is made less than a month and up to a week before the date scheduled for the tour, 50% will be refunded to the customer. Cancellations within 7 days prior to the tour date will be charged at 75%.

7. POLICY OF PROCEDURES AND DEFINITION OF RESPONSIBILITIES

a) Whenever there is a delay on the part of the passengers in relation to the time set for the departure of the vessel, UNIQUE COMPORTA does not refund the amount corresponding to the delay period and there will be no compensation period.

b) Whenever damage is caused to the vessel or other and/or loss of

equipment/material for the responsibility of the passengers, in these situations the customer will fully assume the payment of damages or equipment/material.

8. OPERATING RULES

The use of existing cabins/suites on the vessels is only available when the vessels are hired for programs lasting more than one day, with overnight stays on board.

9. USE OF LICENSE

Permission is granted to temporarily download one copy of the materials (information or software) on the UNIQUE COMPORTA website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not:

a) Modify or copy the materials;

b) Use the materials for any commercial purpose or for public display (commercial or non-commercial);

c) Attempt to disaggregate any software contained on the UNIQUE COMPORTA website;

d) Remove any copyright or other proprietary notices from the materials or

e) Transferring the materials to another person or using the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by UNIQUE COMPORTA at any time. Upon termination of viewing these materials or upon the termination of this license, you must delete all downloaded materials in your possession, whether in electronic or printed format.

10. DISCLAIMER OF LIABILITY

a) The materials on the UNIQUE COMPORTA website are provided as UNIQUE COMPORTA makes no warranties, express or implied, and hereby disclaims and disclaims all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other infringement of rights.

15. APPLICABLE LAW

These terms and conditions are written and interpreted in accordance with the rules of UNIQUE COMPORTA that irrevocably submits to the exclusive jurisdiction of the courts.
